Terms of Use
Effective October 14, 2026 · Last updated October 14, 2026
These terms are an agreement between you and Warpeak Studios LLC (“Warpeak Studios”, “we”, “us”) for your use of our game CardFall (“the game”) and the website warpeakstudios.com. They're also the license agreement for the game. By tapping to accept these terms in the game, or by using the game or the website, you agree to them. If you don't agree, please don't use the game.
1. Who can play
You must be at least 13 years old to use the game. If you're under 18 (or under the age of majority where you live), a parent or legal guardian must read and agree to these terms, both for themselves and on your behalf, before you play or buy anything, and is responsible for your use of the game, including all purchases made with your device or Apple Account. Parents can control or block purchases using Apple's Ask to Buy and Screen Time settings.
2. Your license to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the game on Apple-branded devices you own or control, for your own non-commercial entertainment, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including use by other accounts in your Family Sharing group where the App Store allows it. The game is licensed, not sold. We and our licensors keep all rights in the game, including its code, art, music, characters and names.
3. Virtual currency and items
The game includes virtual currencies, such as gems and coins, and virtual items, such as packs, gear, themes, card designs and energy (together, “virtual items”). You can earn them by playing or by watching optional ads, and you can buy some of them with real money.
- Virtual items have no real-world monetary value and aren't your property. You receive a limited, revocable license to use them in the game.
- They can't be sold, traded, transferred or exchanged for real money, goods or anything outside the game, and we won't redeem them for cash.
- Virtual currency is used up when you spend it, and items you get with virtual currency can't be returned for currency. Refunds for real-money purchases are handled by Apple under its policies (see section 4). Other than that, we don't provide refunds or exchanges for virtual items, unless the law requires it.
- Your progress, including currency and items you bought with real money, is saved only on your device. If you delete the game, reset or lose your device, or your device isn't restored from a backup, your progress is lost and we can't recover it. Permanent purchases, such as gear sets, can be restored with Restore Purchases as described on our Support page.
- Some items, such as packs and chests, give random rewards, whether you get them with real money or with virtual currency. Before you buy one, the game shows what it can contain and the odds of getting each rarity. Unless the game shows otherwise, each item within a rarity has an equal chance. We won't change the odds without updating what the game shows.
- Energy is used when you start a level and refills over time. You can also get more by watching optional ads or with gems.
- We may change, rebalance or remove virtual items and their prices as the game develops. We won't take away items you've already bought with real money, except to correct cheating, bugs or errors, or where a purchase is refunded or reversed.
- If we stop selling or supporting the game, we'll try to give at least 30 days' notice in the game and will stop selling virtual currency when we give that notice. Because the game runs on your device, you can generally keep playing with what you have, but ads and new purchases may stop working.
4. In-app purchases
All purchases with real money are made through Apple's App Store and processed by Apple under its own terms, including pricing, payment, refunds and any right you have under local law to cancel a purchase. We don't handle your payment. To ask for a refund, go to reportaproblem.apple.com. Parents can control purchases with Apple's Ask to Buy and Screen Time settings. If something you bought didn't arrive, contact us at support@warpeakstudios.com.
5. Ads
The game offers optional ads you can watch for in-game rewards. Rewards are given after the ad finishes and may be limited per day. If an ad doesn't load or isn't watched to the end, the reward isn't given. Ads aren't always available, and daily limits may change. Ads are provided by third-party partners. See our Privacy Policy.
6. Fair play
Please don't:
- cheat, or use hacks, bots, modified versions of the game or tools that give an unfair advantage or change how it works;
- copy, modify, reverse engineer, decompile or extract parts of the game, except where the law allows this despite these terms;
- use bugs to gain virtual items. Please report them to us instead;
- use the game or the website in any unlawful way or in a way that interferes with them.
We may correct balances and remove items that come from cheating or bugs, and we may end your license if you break these terms.
7. Feedback
We love hearing ideas. If you send us feedback or suggestions, we may use them freely without owing you anything.
8. Updates and availability
We may update the game, add or remove features, or require you to install an update to keep playing. Some features may need an internet connection, for example to watch ads or make purchases. We don't promise the game will always be available or free of errors.
9. Disclaimers
THE GAME AND THE WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS. TO THE FULLEST EXTENT PERMITTED BY LAW, WARPEAK STUDIOS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DON'T WARRANT THAT THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOUR PROGRESS OR VIRTUAL ITEMS WON'T BE LOST.
Some places don't allow some or all of these disclaimers, so they may not apply to you.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WARPEAK STUDIOS AND ITS MEMBERS, EMPLOYEES AND CONTRACTORS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, VIRTUAL ITEMS, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO THE GAME, THE WEBSITE OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE GAME, THE WEBSITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE GAME IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US$50.
Nothing in these terms limits or excludes liability that can't be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence.
11. Ending these terms
You can stop at any time by deleting the game. We may suspend or end your license if you break these terms. When these terms end, your license ends, but the last two sentences of section 2 and sections 3, 6 (last paragraph), 7, 9, 10, 11, 12, 13, 15 and 16 continue to apply, along with any other part that by its nature should.
12. Apple App Store terms
If you got the game from Apple's App Store, these additional terms apply, and they take priority over anything else in these terms that conflicts with them:
- Acknowledgement. These terms are between you and Warpeak Studios only, not Apple Inc. (“Apple”). Warpeak Studios, not Apple, is solely responsible for the game and its content. These terms don't provide usage rules that conflict with the Apple Media Services Terms and Conditions as of the date you accept them.
- Scope of license. Your license to the game is a non-transferable license to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the game may also be accessed and used by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. Warpeak Studios is solely responsible for providing any maintenance and support for the game, as described in these terms or as required by law. Apple has no obligation whatsoever to provide any maintenance or support for the game.
- Warranty. Warpeak Studios is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the game (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the game, and any other claims, losses, liabilities, damages, costs or expenses caused by any failure to conform to any warranty are Warpeak Studios' sole responsibility.
- Product claims. Warpeak Studios, not Apple, is responsible for addressing any claims by you or any third party relating to the game or your possession and use of it, including: (i) product liability claims; (ii) any claim that the game fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar laws. Section 10 limits our liability to you only as far as applicable law allows.
- Intellectual property. If a third party claims that the game, or your possession and use of it, infringes that third party's intellectual property rights, Warpeak Studios, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Please direct any questions, complaints or claims about the game to: Warpeak Studios LLC, PO Box 87, Dunmore, PA 18512, United States; phone +1 (570) 362-6950; email support@warpeakstudios.com.
- Third-party terms. You must comply with any applicable third-party terms when using the game, such as your wireless data service agreement and the Apple Media Services Terms and Conditions.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
These terms are the license agreement for the game and replace Apple's standard Licensed Application End User License Agreement.
13. Disputes
Talk to us first. If you have a problem with the game or these terms, please contact us first at support@warpeakstudios.com or the address in section 16, describing the problem and what you'd like us to do. We'll do the same if we have a dispute with you. We'll both try in good faith to resolve it informally. If it isn't resolved within 60 days, either of us may start a court case as described below. Any time limit for bringing a claim is paused during those 60 days. This doesn't stop either of us from going to small-claims court, or from seeking urgent court orders to stop misuse of intellectual property.
Governing law. These terms, and any dispute about the game, the website or these terms, are governed by the laws of the Commonwealth of Pennsylvania and applicable US federal law, without regard to conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods doesn't apply.
Where disputes are heard. Any dispute not resolved informally will be heard only in the Court of Common Pleas of Lackawanna County, Pennsylvania, or the United States District Court for the Middle District of Pennsylvania, and you and we consent to the personal jurisdiction of those courts. Either of us may instead bring an individual claim in a small-claims court where you live or in Lackawanna County. If you live in a country whose consumer laws give you the right to bring claims in your local courts or to rely on your local mandatory laws, nothing in these terms takes away those rights.
14. Changes to these terms
We may update these terms, for example when we add features. We'll post the updated terms on this page with a new effective date. If a change is material, we'll also tell you in the game at least 15 days before it takes effect, unless a change is needed sooner for legal, safety or security reasons. If you keep using the game after a change takes effect, the updated terms apply. If you don't agree, stop using the game and delete it. Changes won't apply to any dispute that arose before the change took effect.
15. General
- Entire agreement. These terms are the whole agreement between you and us about the game and the website and replace any earlier agreements about them. Our Privacy Policy explains how we handle information.
- Severability. If any part of these terms is found unenforceable, it will be enforced to the greatest extent permitted, and the rest of these terms will stay in effect.
- No waiver. If we don't enforce a part of these terms, that doesn't mean we give up the right to enforce it later.
- Assignment. You can't transfer your rights or obligations under these terms. We may transfer ours to a company that takes over the game, for example through a merger, acquisition or sale of assets.
- Events outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages of Apple's or our partners' services, internet failures, natural disasters or government action.
- Notices. We may give you notices in the game or on this website. You can give us notices by email or mail using the details in section 16.
- Export and sanctions. You agree to comply with US export control and sanctions laws when using the game.
- Headings and language. Headings are for convenience only. If we provide a translation of these terms, the English version controls where the law allows.
